COOPS & CONDOMINIUMS LAW
A growing area of the firm's practice is representing cooperative corporations and condominium boards. The firm's attorneys build lasting
relationships with co-op and condominium clients by providing personal and cost-effective representation. Clients can expect that Kennedy & Gillen
will provide comprehensive solutions for matters ranging from simple disputes between neighbors to complex refinancing of the underlying mortgage
on the property.
Clients rely on the firm to:
- Provide the Board with general legal advice on day-to-day matters
- Attend annual shareholders meetings to address legal matters on behalf of the Board
- Prepare, revise and interpret legal documents including the by-laws, proprietary lease, house rules, alteration agreements,
sublet agreements, default notices, and living trust agreements
- Review, negotiate and prepare agreements with third parties, such as managing agents and service providers including landscapers,
snow removal firms, security guards, contractors, engineers, and project managers
- Prepare, review and negotiate AIA agreements for projects such as roof work, boiler replacement, sidewalk and parking lot repair,
exterior renovation and other property improvements
- Act as the transfer agent in the closings of apartment transfers and loan refinances-at no cost to the cooperative corporation
- Assist in negotiating the terms of commitment letters and all loan documents through closing when refinancing the property's underlying mortgage
- Provide representation in housing court proceedings against tenant-shareholders who are in default of their proprietary leases
- Litigate breach of contract actions for construction defects and other disputes
- Defend the cooperative corporation or condominium board in claims not defended by insurance counsel
- Regularly advise on changes in governmental requirements affecting Boards such as notice requirements when denying an applicant
- Appear on behalf of Boards in administrative proceedings to defend claims of discrimination
